An affiliate of defunct solar utility developer SolarReserve Inc. has no right to inspect the books of Tonopah Solar Energy LLC, a failed Nevada power plant project it founded and lost control of, a Delaware judge ruled, citing his previous decision rejecting SolarReserve’s bid to dissolve the venture.
“As it turns out, this action is ‘déjà vu all over again,’” Vice Chancellor Joseph R. Slights III wrote July 24, quoting Yogi Berra. “SolarReserve once again has sought to exercise rights it knowingly bargained away.”
