Smash My Trash Loses Preliminary Bid to Shut Down Dumpster Devil

Smash My Trash LLC can’t stop Dumpster Devil LLC from operating its trash compacting business during litigation over claims that its founders feigned interest in setting up a Smash My Trash franchise in a scheme to steal trade secrets, a Delaware Chancery Court judge ruled.

The actions of Dumpster Devil’s founders “were disingenuous and underhanded,” Vice Chancellor J. Travis Laster wrote Thursday. “They did not, however, acquire legally protected information that could support the type of broad preliminary injunction that Smash seeks.”
