Prime, Walgreens Appear to Settle Over AllianceRx Joint Venture

Prime Therapeutics LLC and Walgreen Co. have resolved a dispute in Delaware over allegations that Walgreens breached their joint venture agreements by competing under its own flag against AllianceRx, the specialty and mail-order prescription service backed by both of them.

Vice Chancellor Paul A. Fioravanti Jr. dismissed the case Tuesday from Delaware’s Chancery Court, a few hours after the two pharmacy giants told the judge Prime was dropping its contract and fiduciary breach claims.

The filing doesn’t expressly state that there’s a settlement, and attorneys for both sides didn’t immediately respond Tuesday to requests for comment or more information.
