Prime Says Walgreens Is Competing Against AllianceRx Venture (1)

Prime Therapeutics LLC sued Walgreen Co. in Delaware, claiming it’s violating their joint venture agreements by starting to compete under its own flag against AllianceRx, the specialty and mail-order prescription service backed by the two pharmacy giants.

The lawsuit, filed in Delaware Chancery Court, accuses Walgreens of breaching both its contracts with Prime and its fiduciary duties toward the joint venture by setting up “central fill” drug distribution programs at certain retail locations “that compete or will compete directly with AllianceRx.”
