Perion Beats Investor Suit Over Bing Traffic Quality for Now (1)

Perion Network Ltd. defeated allegations it misled investors over the quality of traffic the advertising technology company sent to Microsoft Corp. before search engine Bing excluded several publishers from its marketplace, a federal judge ruled.

The investors failed to adequately allege a former CEO’s intent or recklessness while delivering a pair of statements in 2022 about its quality, Judge Valerie Caproni said while dismissing the case.

They sufficiently claimed former CEO Doron Gerstel’s statements that standards were “impeccable” when Perion was purportedly offering low-quality traffic were misleading, the US District Court for the Southern District of New York judge said. ...
