Newsmax ‘Forum Shopping’ Chided by Judge in Fox Monopoly Suit

An antitrust case accusing Fox News of monopolizing the US right-leaning pay TV news market has been transferred from Wisconsin to a Florida court, after a federal judge concluded that the plaintiff, Newsmax Broadcasting LLC, was forum-shopping.

Newsmax voluntarily dismissed its case in Florida and then refiled a nearly identical complaint against Fox News “with no explanation for choosing this venue,” Judge William M. Conley of the US District Court for the Western District of Wisconsin said.

“Without casting any great aspersions, this is forum shopping,” he said.
