Nasdaq Diversity Loss Aids Climate Rule Ruin, Ex-SEC Member Says

A recent Fifth Circuit decision tossing Nasdaq rules aimed at getting more women and minorities on company boards will pave the way for a different federal appeals court to scrap the SEC’s corporate emissions reporting requirements, a former agency commissioner said Thursday.

The board diversity rules’ demise at the US Court of Appeals for the Fifth Circuit on Dec. 11 gave another court ammunition to end the Securities and Exchange Commission’s March climate regulations, said Joseph Grundfest, a Democrat appointed to the SEC during the Ronald Reagan administration.
