Nasdaq Board Diversity Opinion Appealed by Conservative Group

A conservative group on Wednesday appealed a decision by a panel of judges on the Fifth Circuit that allows Nasdaq to keep SEC-endorsed rules that aim to place more women and minorities on the boards of its listed companies.

The Alliance for Fair Board Recruitment is seeking a rehearing by the full court after the three-judge panel for the US Court of Appeals for the Fifth Circuit decided last week that the Securities and Exchange Commission had the authority to approve the board diversity rules in 2021. The rules are slated to take effect this year.
