A damages award totaling $1.6 million for the theft of trade secrets about recycling supermarket food waste will stand, the Delaware Supreme Court said Thursday.
California Safe Soil LLC had argued an award between $40.7 million and $138 million would better reflect the value of its proprietary process for recycling food waste into fertilizer and animal feed. A one-page order signed by Justice Abigail M. LeGrow affirmed the January Delaware Chancery Court ruling that set damages at $1.6 million, plus pre- and postjudgment interest.
