DLA Piper Malpractice Case Could Break Ground in Second Circuit

A legal malpractice case against DLA Piper could result in the “first time ever” that the US Court of Appeals for the Second Circuit determines it has jurisdiction over a malpractice action, said Judge Joseph Bianco at a Thursday hearing.

“We have never found a malpractice action under any circumstances should remain in federal court,” said Bianco in the case brought by former DLA client Link Motion Inc., a Chinese software company.

The three-judge appellate panel, which also included Judges Reena Raggi and Pierre Leval, will decide whether the federal district court had subject matter jurisdiction, and whether the judge ...
