A New York federal district court denied in part a motion to dismiss defamation counterclaims under New York state law, finding that defendant adequately alleged actual malice to overcome qualified privilege where he alleged plaintiff made false statements about sexual misconduct to BronxWorks, Inc. employees and police, ruling that if defendant only gave plaintiff a hug and kiss on the forehead as alleged, plaintiff would have known her contrary allegations were false.
