Carlyle Loses Bid to End Bain Capital Suit Over Property Venture

Carlyle Group Inc. must face litigation over claims that it meddled in a commercial real estate joint venture by working with a property developer to usurp business opportunities from a Bain Capital LP affiliate, a Delaware judge ruled.

Vice Chancellor Sam Glasscock III let the Bain affiliate, Atlantic NWI LLC, move forward in the state’s Chancery Court with one tortious interference count against Carlyle, which wasn’t party to the agreements between Atlantic and the developer, REDCO Fund I Manager LLC. REDCO has already settled.
