Blue Bell Creameries LP fell short in its attempt to dismiss a lawsuit alleging racial discrimination, hostile work environment, and retaliation, with a federal judge allowing the case to move forward.
The ruling comes as Blue Bell is defending a derivative lawsuit at trial in Delaware Chancery Court alleging its senior leaders missed red flags and failed to adequately monitor operations leading up to a fatal 2015 listeria outbreak.
