A Latin American businessman fighting a Mexican media mogul known as “the Ghost” over an Argentine company didn’t forfeit attorney-client privilege by sending personal legal emails through a server controlled by his adversary, a Delaware judge said Nov. 19.
The ruling by Vice Chancellor Morgan T. Zurn appears to represent just the second time the Chancery Court has considered whether the privilege covers emails sent over an employer-controlled server. Zurn said the test laid out in the previous case should yield to an Argentine email privacy law.
