AMC ‘APE’ Vote Gets Green Light, But Charter Changes Must Wait

AMC Entertainment Holdings Inc. got permission from a judge Monday to hold a disputed investor vote, but the company will have to wait until at least late April to make class A stock out of “APE” units representing fractional preferred shares.

Vice Chancellor Morgan T. Zurn allowed the theater operator to move forward with its March 14 special meeting. AMC can tabulate and report the results of the shareholder vote, but it can’t actually implement any charter changes until the judge finishes weighing an injunction bid by a pension fund and other investors leading the litigation, she said.
