The Texas Supreme Court agreed on Friday to review a state government lawsuit over Volkswagen AG and Audi AG “diesel cheat” software updates, to clear up whether Texas has “specific personal jurisdiction” over the companies.
The consolidated cases have been set for oral argument Feb. 22.
The Texas Court of Appeals, Third District, had previously decided in a divided opinion to reverse a trial court’s decision allowing the state’s alleged tampering claims under the Texas Clean Air Act and related regulations to proceed against the German companies.
