Virginia landowners filed an emergency motion in the D.C. Circuit to stop Mountain Valley Pipeline LLC from constructing its more than 300-mile natural gas pipeline through their properties.
The landowners refused to sell their properties to the company, so MVP looked to acquire the land through the power of eminent domain under the Natural Gas Act. The federal law says the recipient of a certificate of public convenience and necessity will also acquire the right of eminent domain, and the Federal Energy Regulatory Commission issued the certificate in October 2017.
