Utah Guardianship Law for Mentally Disabled People Survives Suit

A challenge to the new guardianship process for individuals with severe mental disabilities adopted by Utah was dismissed by a federal court.

The plaintiff, Disability Law Center, didn’t sue the right people and didn’t have standing, Judge Robert J. Shelby said Tuesday for the US District Court for the District of Utah.

DLC is a private nonprofit organization that advocates for Utah’s population with disabilities, including people with intellectual disabilities. It’s the state’s “authorized protection and advocacy organization,” Shelby wrote.
