The US Supreme Court has rejected a petition to hear a case challenging a 2019 Texas law that allows only electric utilities with an existing in-state presence to construct new transmission lines for the interstate power grid.
The high court responded to a petition Monday from Texas after an appeals court ruled in August 2022 the law was unconstitutional. The US Court of Appeals for the Fifth Circuit overturned a district court finding that backed the law because it regulates only the construction and operation of transmission lines and facilities within Texas.
