The US government has expanded its legal rationale for asserting the Department of Defense can’t be held liable for alleged nationwide PFAS damage under two statutes.
The Department of Justice filed on Monday three motions detailing its rationale for asking the US District Court for the District of South Carolina to dismiss allegations that the military is liable for alleged damage from certain widely used fire suppressants containing per- and polyfluoroalkyl substances (PFAS).
Two motions address alleged nationwide liability, while the third focuses on damage that New Mexico state and four dairies say Cannon Air Force Base has caused.
