Updated Amazon Nuclear Power Deal Moots Lawsuit, FERC Argues

A nuclear plant owner’s challenge to the Federal Energy Regulatory Commission’s denial of an electricity agreement with Amazon is moot and should be dismissed, the commission argued.

The court lacks jurisdiction because the company “has already contracted to abandon the behind-the-meter co-location arrangement at issue in this appeal,” FERC said in its brief filed Oct. 3 with the US Court of Appeals for the Fifth Circuit.

“In June 2025, Susquehanna’s parent company, Talen Energy Corporation, contracted with Amazon Web Services to abandon Susquehanna’s current behind-the-meter co-location scheme,” the commission said.
