United Refining Co. Must Follow EPA Fuel Blending Requirements

United Refining Co. must participate in the Environmental Protection Agency’s Renewable Fuel Standard program, after the Third Circuit ruled that it didn’t merit a hardship exemption.

The program, authorized by Congress in 2005, requires gas and diesel fuel refiners, blenders, and importers to ensure that a portion of their fuel production consists of renewable fuels—but grants exemptions to small refineries that would experience a disproportionate economic hardship from compliance.

Congressional investigators found in November 2022 that small oil refineries pay more than larger competitors to fulfill the blending mandates, which could lead the EPA to lower requirements.
