Unico Mechanical Corp. showed that the US Army Corps of Engineers didn’t satisfy Buy American Act requirements when it awarded McMillen LLC a $4 million construction contract, the GAO said in a decision released Tuesday.
The agency should reevaluate bids and make a new award decision for construction at the Cougar Dam power plant in Oregon, the Government Accountability Office said.
The request for proposals included a clause incorporating the Buy American Act. The clause generally requires contractor to use only use domestic construction material.
