Trump Water Rule Rework Warrants Suit’s Dismissal, Agencies Say

The EPA and Army Corps of Engineers asked a California federal court to send the Trump administration’s rule narrowing protections for “waters of the United States” back to the agencies and to dismiss the legal challenge to the rule.

Remand is appropriate because the agencies finished their review of the Navigable Waters Protection Rule and decided to revise or replace the rule, according to the filing in the U.S. District Court for the Northern District of California.
