Trump EPA Gets Time to Respond in Challenge to Solvent Risk Plan

A federal appeals court has given the EPA 90 days to decide how it wants to address Union Carbide Corp.'s petition to challenge the 1,4-dioxane risk evaluation the agency revised during the Biden administration.

The US Court of Appeals for the Fifth Circuit on Wednesday placed the case in abeyance through April 29, inviting the agency and company by then to submit joint or separate motions about how to proceed. This could offer a glimpse into the Environmental Protection Agency’s latest approach to chemical risk evaluation policies that determine whether regulations are needed.
