States challenging a pause on federal offshore wind leasing declared victory after the Trump administration dropped its appeal of a court order undoing the policy.
The US Court of Appeals for the First Circuit Monday granted the Justice Department’s voluntary dismissal of its appeal of a district court’s December order vacating a January 2025 executive order halting all federal approvals for outer continental shelf wind-energy leasing.
The US District Court for the District of Massachusetts sided with a coalition of more than a dozen states who sued, ruling the order was “arbitrary and capricious and contrary to law.”
