The Trump administration is asking a judge to side with a group of red states in their lawsuit trying to strike down New York’s climate Superfund law that would make select polluters pay for their emissions.
The Department of Justice alleged in a brief filed Nov. 7 that New York’s law violates the US Constitution and is pre-empted by the Clean Air Act. The administration alleged the law is at odds with US foreign policy by adding to “the national energy emergency by imposing crushing penalties on global energy production,” among other things.
