A large ranch outside of Houston challenged a federally funded wind turbine project alleging endangered birds could be hurt while migrating.
Blue Creek Real Properties sued the Department of Treasury as one of the primary backers of the Lane City Wind project. The entities failed to follow Endangered Species Act procedures despite protected birds like the Bald Eagle and Whooping Crane being at risk.
The government and Lane City Wind LLC evaded an environmental review of the project by the US Fish and Wildlife Service and failed to receive incidental take authorization, according to the suit.
