Well owners can proceed as a class in their claim alleging they were improperly and intentionally underpaid royalties for gas processed through a Texas processing plant, a federal court ruled.
Damages and breach can be shown on a classwide basis because Devon Energy Production Co. applied a uniform pricing structure to every well in the system, Judge Ed Kinkeade of the U.S. District Court for the Northern District of Texas said Tuesday.
The owners met the commonality requirements of Federal Rule of Civil Procedure 23(a) and predominance requirements of Rule 23(b), the court ruled.
