Texas Court Reverses $2.64 Million Judgment Against Dow Chemical in Asbestos Removal

Dow Chemical Co. is off the hook for a $2.64 million judgment awarded to the family of a contractor who performed asbestos insulation repairs at a Dow plant, a Texas appeals court has held (Dow Chemical Co. v. Abutahoun, Tex. Ct. App., No. 5-11-1277-CV).

Dow did not have control over the contractor’s work while he was on the premises and did not have actual knowledge of the dangers that caused his injury, the Texas Court of Appeals, Fifth District, said in the Feb. 8 decision.
