Tennessee Gas Expansion Project Gets D.C. Circuit’s Sign-Off

Tennessee Gas Pipeline Co. can go ahead with construction on a new natural gas compression facility outside of Nashville even though the Federal Energy Regulatory Commission was “decidedly less-than-dogged” during the certification process, the D.C. Circuit said June 3.

The arguments made by the Nashville residents challenging the agency’s process in granting a certificate of public convenience to the Broad Run Expansion Project couldn’t overcome the general deference reviewing courts give to agency actions, the court said in its per curiam opinion.
