Murfreesboro, Tenn., can continue its lawsuit against waste disposal companies for landfill odors and discharge, after a federal court denied dismissal of several claims.
The city sufficiently alleged an injury for its negligence claim by providing examples of property damage and economic loss from monitoring and consulting expenses, Judge Eli J. Richardson of the US District Court for the Middle District of Tennessee said Tuesday. The court also denied dismissal of the city’s private nuisance and breach of contract claims.
