Supreme Court Will Hear Renewable Fuel Standard Exemption Suit

The US Supreme Court on Monday decided to hear a case from the Environmental Protection Agency over the requests of small refineries to be exempt from Renewable Fuel Standard program responsibilities.

Under the Clean Air Act, the agency is responsible for the RFS program, which sets the amount of renewable fuel required to be blended annually into the nation’s supply of gasoline and diesel fuel.

Small refineries can request exemptions from their renewable fuel obligations if they show they’d experienced “disproportionate economic hardship.” In 2022, the EPA issued two actions that collectively denied 105 such requests by 36 small refineries, ...
