The US Supreme Court need not take up a lawsuit over the disposal of nuclear waste in Texas, because Congress has already explicitly directed where such waste should be stored in the U.S, a filing by the state’s attorney general said.
Attorney General Ken Paxton (R) said in a brief Wednesday a federal appeals court correctly rejected a Nuclear Regulatory Commission attempt to license the disposal of nuclear waste in Texas because the Atomic Energy Act clearly allows only one storage site, in Nevada’s Yucca Mountain.
