The US Supreme Court Monday declined to review from a Seattle-area port to determine the scope of the Clean Water Act’s citizen suit provision.
The Port of Tacoma, SSA Terminals LLC and affiliated companies lost their bid present their case aiming to restrict federal courts’ authority to enforce a state’s pollutant discharge permit.
The companies petitioned the court last year after the US Court of Appeals for the Ninth Circuit ruled that the marine terminal operators violated their Washington-issued Industrial Stormwater General Permit due to excess stormwater runoff.
