A refrigerants company backed by the New Civil Liberties Alliance is asking the Supreme Court to set aside part of a 2020 law meant to phase down the use of planet-warming hydrofluorocarbons (HFCs).
The American Innovation and Manufacturing Act—a Democrat-sponsored law that authorizes the EPA to phase down HFC production and use by 85% by 2036—doesn’t tell the agency how it must allocate 98% of the allowances in the HFC market, according to the petition for writ of certiorari filed Feb. 27.
