States’ Carbon Costs Dispute Sees Eighth Circuit Skepticism (1)

A panel of Eighth Circuit judges appeared to strongly favor affirming a trial court order dismissing a lawsuit brought by Missouri and a dozen other states, challenging the use of interim estimates on the costs of greenhouse gases, during oral arguments Thursday.

The states want the US Court of Appeals for the Eighth Circuit to revive their suit after a judge held they lacked standing to sue and their claims weren’t ripe for the court.

Dean John Sauer, of the Missouri Attorney General’s Office, told the panel that the working group that created the binding estimates has no legislative authority. ...
