A General Atomics Aeronautical Systems Inc. unit and the St. Louis Airport Authority on Wednesday lost their bid to shake a suit brought by two sisters who allege the entities exposed them to radioactive waste that caused their cancer.
The US Court of Appeals for the Eighth Circuit ruled federal nuclear dosage regulations don’t preempt state standards in Nikki Mazzocchio and Angela Kraus’s public liability suit. In so doing it opened a circuit split, saying the other courts had provided no persuasive reason to disregard the plain text of the Price-Anderson Act.
