Sixth Circuit Asked to Revive Emissions-Cheating Suit Against GM

A group of drivers asked the Sixth Circuit to revive their claims alleging that General Motors LLC deceptively marketed its Duramax trucks as “clean” even though they were rigged with emissions-cheating software.

GM claimed that Duramax engines—in its popular Silverado and Sierra HD vehicles—turn “heavy diesel fuel into a fine mist,” resulting in low emissions. But emissions testing has revealed that the vehicles emit levels of nitrogen oxides many times higher than their gasoline counterparts, the 2017 consolidated would-be class action said.
