A federal district court allowed the Sierra Club to voluntarily withdraw its lawsuit over EPA’s failure to cite 12 states for failing to submit plans to address cross-border ozone-forming pollution.
The U.S. District Court for the District of Columbia agreed to the request Dec. 16.
The Sierra Club told the court the “substance of its lawsuit is resolved” now that Environmental Protection Agency has formally acknowledged the states that met or violated the Clean Air Act provision, requiring a plan to address transport of ozone-forming pollution into neighboring states.
