An asbestos removal company did not control a worksite at an Alabama power station when asbestos-containing material was found there, a judge found (Sec’y of Labor v. Vulcan Indus. Contractors Co., OSHRCJ, No. 16-0445, 4/10/17).
The Labor Department failed to establish that a sample taken from a scaffolding plank resulted from work performed by Vulcan Industrial Contractors Co., LLC, at the site, according to John B. Gatto, an administrative law judge at the Occupational Safety and Health Review Commission.
