Refinery operators won their legal petition Tuesday challenging the Environmental Protection Agency’s refusal to provide an exception to its renewable fuel standards for small refineries.
“Because the EPA’s interpretation of its own regulation is contrary to the provision’s plain text, we vacate the EPA’s denial orders and remand to the agency for further proceedings,” the US Court of Appeals for the DC Circuit said in its opinion.
