North Dakota, West Virginia, Texas and a group of other Republican-led states are beginning the legal brawl against mercury air toxics standards in a petition for review filed on Wednesday.
The 23 states are part of various other lawsuits currently pending across the US against the Environmental Protection Agency’s suite of rules that target industrial emissions.
The EPA did not immediately respond to a request for comment.
This petition for review, filed at the US Court of Appeals for the District of Columbia Circuit, targets air quality limits that stem mercury and other heavy metal emissions from coal-fired plants.
