Red States’ Suit Over Nuclear Reactor License Costs Put on Hold

Conservative states’ challenge over the Nuclear Regulatory Commission’s license fees for small reactors was put on pause until the end of June while the parties discuss next steps.

Judge Jeremy D. Kernodle of the US District Court for the Eastern District of Texas on Thursday granted the motion to hold the case in abeyance. Texas, Utah, Louisiana, Florida, Arizona, and related entities brought the suit in December, accusing the agency of exceeding its authority by requiring the same license and fee for small research reactors as for reactors large enough to pose significant threats to the public.
