A would-be exotic dancer can try again with a lawsuit arguing that a club declined to hire her because she’s Black after the Eleventh Circuit on Thursday said her attorney’s clerical errors aren’t grounds for dismissal.
The lower court tossed the worker’s racial discrimination claims against Best In Town Inc. after her lawyer missed a telephone conference and in-person hearing. But the attorney’s “oversights, although imperfect, fall short of supporting a clear pattern of delay and willful misconduct,” the US Court of Appeals for the Eleventh Circuit said in an unpublished opinion.
