Quemetco Inc. and International Metals Ekco Ltd. escaped liability for pollution from a lead smelter near Los Angeles, according to a federal judge who said that the companies qualified for a recycling exemption under CERCLA and a California hazardous substance act.
California sued Quemetco, NL industries, and several other companies under the Comprehensive Environmental Response, Compensation, and Liability Act and other similar laws at the US District Court for the Central District of California. It alleged that they owned, operated, or sent hazardous waste to a smelter in Vernon, Calif., leading to more than $136 million in cleanup costs.
