An electric public utility lost its bid to have retail customers pick up a portion of a $135 million refund that the Federal Energy Regulatory Commission ordered to be paid to other energy companies.
The Arkansas Public Service Commission’s order denying Entergy Arkansas LLC’s application for the refund wasn’t arbitrary, capricious, or in violation of federal law, Judge Brian S. Miller of the US District Court for the Eastern District of Arkansas said Thursday.
The APSC’s order was supported by “substantial evidence,” Miller said in his 31-page decision, dismissing the power company’s case.
