PPG Industries Inc. must face a potential fine for releasing pollution at a site in Pennsylvania without a valid permit, even though the state already accepted a $1.2 million payment from the company, a federal court ruled.
PPG argued the penalty it paid to the Pennsylvania Department of Environmental Protection made this claim moot. But it’s not impossible for a federal court to grant further relief even though a defendant paid penalties to a state, according to the U.S. District Court for the Western District of Pennsylvania.
