A bid to transfer an environmental case against Johnson Controls Inc. from federal to state court failed for a third time Aug. 28, with the Northern District of Indiana expressing “astonishment” at the effort expended by plaintiffs’ counsel in seeking the transfer (Hostetler v. Johnson Controls, Inc., 2017 BL 301600, N.D. Ind., No. 15-cv-00226, 8/28/17).
The ruling denied Amos Hostetler’s motion to remand his citizen suit filed under the Resource Conservation and Recovery Act, a federal law governing solid waste disposals, to a state court considering related class claims against the company.
