Pipeline Contractor Gets Early Win in Suit Over Undelivered Wood

A Pennsylvania pipeline contractor should prevail over claims that it failed to deliver wood to a timber harvesting company, a magistrate judge said in a report and recommendation.

Frank Krammes Timber Harvesting Inc. alleged that it sought approval from the Federal Energy Regulatory Commission, modified its facilities, and trained employees after Letourneau Enterprises LLC promised to deliver wood from the Atlantic Sunrise Pipeline Project. But Letourneau instead delivered the materials to sites operated by third parties, Krammes said in its lawsuit.
